LIMITED WORKMANSHIP WARRANTY

EpoxyGuys warrants that the floor coating system identified above will be installed in accordance with the agreed scope of work and generally accepted installation practices.

During the stated warranty period, EpoxyGuys will repair areas determined by EpoxyGuys, after reasonable inspection, to have failed as a direct result of defective installation workmanship, subject to the terms, conditions, limitations, and exclusions contained in this warranty.

This is a limited workmanship warranty and is not a guarantee against all damage, deterioration, cracking, discoloration, or coating failure.

Subject to the exclusions below, this warranty covers coating failure directly caused by defective installation workmanship, including:

EpoxyGuys’ obligation under this warranty is limited to repairing or recoating the affected area as reasonably necessary.

Concrete cracking is not covered by this warranty.

Concrete naturally expands, contracts, settles, and moves over time.

Although EpoxyGuys may repair existing cracks before applying a coating, no crack-repair method can guarantee that an existing crack will never reappear or that new cracks will not develop.

This warranty does not cover:

A coating installed over concrete cannot prevent the underlying concrete from moving or cracking.

Failures caused by moisture are not covered unless a specific written moisture warranty was separately provided by EpoxyGuys.

This warranty excludes damage or coating failure resulting from:

Concrete can contain or transmit moisture that was not visible at the time of installation.

EpoxyGuys warrants its installation workmanship, not the structural integrity or future condition of the customer’s concrete.

This warranty does not cover coating failure resulting from:

Floor coatings are durable but are not indestructible.

Normal wear and tear is not considered a workmanship defect and is not covered.

This warranty does not cover damage resulting from:

Unless specifically warranted in writing, EpoxyGuys does not guarantee that the coating will resist every chemical, fluid, stain, or contaminant.

Damage caused by prolonged or excessive exposure to chemicals or substances outside the coating manufacturer’s specifications is excluded.

Spills should be cleaned promptly in accordance with the EpoxyGuys Floor Care & Maintenance Instructions.

Some coating materials may experience changes in color, gloss, or appearance when exposed to sunlight or ultraviolet radiation.

Unless the installed system is specifically represented in writing as UV-stable or UV-resistant, yellowing, fading, discoloration, or other changes resulting from UV exposure are not covered.

Even UV-resistant products may experience some change in appearance over time.

Epoxy, polyaspartic, flake, metallic, and other decorative coating systems are custom-applied finishes.

Natural variations in the finished floor are expected.

This warranty does not cover reasonable variations in:

Metallic flooring in particular is individually created and cannot be guaranteed to exactly match samples, photographs, or another installation.

No coated flooring surface can be guaranteed to be completely slip-proof.

EpoxyGuys is not responsible under this warranty for changes in traction caused by water, snow, ice, oil, grease, chemicals, contaminants, improper maintenance, or normal wear.

To maintain eligibility under this warranty, the customer must:

Failure to follow applicable care, cure, and maintenance instructions may affect warranty coverage to the extent the failure caused or contributed to the claimed damage.

To request warranty service, the customer must contact EpoxyGuys and provide:

EpoxyGuys must be provided a reasonable opportunity to inspect the floor and determine the cause of the reported condition.

The customer should not have another contractor repair, remove, coat, grind, or otherwise alter the affected area before EpoxyGuys has had a reasonable opportunity to inspect it, except when reasonably necessary to prevent additional property damage or address an emergency.

If EpoxyGuys determines that a covered workmanship defect exists, EpoxyGuys will, at its option and as reasonably appropriate:

Because coatings age and are custom applied, a repaired area may have reasonable differences in color, gloss, texture, flake distribution, or appearance compared with the surrounding existing floor.

Unless otherwise required by applicable law, the remedy provided under this limited warranty is limited to correction of the covered workmanship defect.

Unless otherwise stated below or required by applicable law, this limited workmanship warranty is provided to the original customer identified above for the original installation location.

Certain coating materials may carry separate warranties from their manufacturer.

Any manufacturer warranty is governed solely by the manufacturer’s terms, conditions, exclusions, and claim procedures.

A manufacturer’s warranty does not expand EpoxyGuys’ workmanship warranty unless expressly stated in writing.

This limited warranty is intended to describe the express workmanship warranty provided by EpoxyGuys.

Nothing in this warranty is intended to waive, restrict, or eliminate any right or remedy that cannot legally be waived under applicable Connecticut or federal law.

If any provision of this warranty conflicts with a non-waivable requirement of applicable law, that legal requirement will control.
